Terms of Service

Welcome to Trackthemetric, a service provided by Phroneos BV ("Company", "we", "us" or "our"), a Belgian private limited company (BV) with registered offices at Jabbeke, Belgium. These Terms of Service ("Terms") govern your access to and use of the Trackthemetric platform ("Service").

By accessing or using Trackthemetric, you confirm that you have read, understood, and agree to be bound by these Terms.

1Eligibility

To use our Service, you must be at least 18 years old and have the legal capacity to enter into binding agreements. By using Trackthemetric, you represent and warrant that you meet these requirements.

2Description of Service

Trackthemetric is a privacy-friendly alternative to Google Analytics. It helps you gain insight into website visitor behavior, traffic sources, top-performing pages, and conversions, all from one intuitive dashboard. We aim to provide website owners and marketers with powerful analytics tools without compromising user privacy.

3User Accounts

To access the Service, you must register for an account. You agree to provide accurate and complete information and to keep it up-to-date. You are responsible for maintaining the confidentiality of your login credentials and are liable for all activity under your account.

4Subscriptions and Billing

Trackthemetric operates on a subscription basis. By subscribing, you agree to pay all applicable fees, which will be billed via Stripe.

  • Billing Cycle: Monthly or yearly, depending on your selection.
  • Renewals: Subscriptions renew automatically unless cancelled before the next billing cycle.
  • Cancellations: You can cancel anytime via your dashboard. No refunds are issued for partial billing periods.

5Free Trials

We may offer a free trial period to allow new users to explore the Service. Once the trial period ends, access to the Service will be suspended unless a valid subscription is activated.

We will send multiple email reminders before the trial expires. However, we reserve the right to limit or terminate your access and, if necessary, close your account if no payment is made after the trial period ends.

6Acceptable Use

By using Trackthemetric, you agree to use the Service in compliance with all applicable laws and regulations and to adhere to the following acceptable use requirements. Specifically, you agree not to:

  • Use the Service for any unlawful, harmful, fraudulent, deceptive, or malicious purpose.
  • Upload, store, transmit, or share any content that is illegal, infringing, defamatory, obscene, threatening, abusive, or otherwise objectionable.
  • Attempt to gain unauthorized access to the Service, accounts, or systems connected to the Service.
  • Reverse engineer, decompile, disassemble, replicate, copy, or create derivative works of the Service or its components.
  • Resell, sublicense, or exploit the Service or any part of it for commercial purposes without explicit written permission.
  • Interfere with or disrupt the integrity, performance, or availability of the Service, including introducing viruses, malware, or other harmful code.
  • Use the Service to send unsolicited emails ("spam") or harvest personal data from other users or visitors.
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Use automated tools, bots, scrapers, or crawlers to access or interact with the Service in ways that violate these Terms or place excessive load on our infrastructure.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these Terms, including but not limited to suspending or terminating accounts, removing content, and reporting you to law enforcement authorities if necessary.

7Data Privacy and Processing

By using the Service, you acknowledge that we may process personal data on your behalf. You remain the data controller for any visitor data collected through the Service. For more information, please refer to our Privacy Policy and Cookie Policy.

8Security

We use industry-standard security practices to protect your data. However, no system is 100% secure.

You are responsible for securing your own systems, access credentials, and API tokens. We are not liable for unauthorized access caused by your own mismanagement of these credentials.

9Availability

We strive for a high level of uptime. However, we do not guarantee uninterrupted availability. Occasional downtime may occur for maintenance, upgrades, or factors beyond our control (e.g., hosting provider issues, internet outages).

10Intellectual Property

All intellectual property rights in the Service (excluding your content) belong to Phroneos BV or its licensors. You may not use our branding, logos, or copyrighted materials without permission.

11User Content

You retain all rights to the data you collect using the Service. You grant us a limited license to use your data solely for providing and improving the Service.

12Third-Party Services

The Service may integrate with third-party services such as Supabase, Vercel, Stripe, and analytics/advertising platforms (e.g. Google, Meta, LinkedIn, X Ads). We are not responsible for the practices or content of these third parties.

13Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid by you to us in the twelve months preceding the claim.

14Indemnification

You agree to indemnify and hold harmless Phroneos BV from any claims, losses, damages, liabilities, including legal fees, arising out of your use or misuse of the Service, your violation of these Terms, or any breach of applicable law.

15Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your license to use the Service ends immediately.

16Confidentiality

Both parties agree to treat all non-public information exchanged as confidential and not to disclose it to third parties except as required to provide the Service or as legally required.

17Compliance and Export Restrictions

You agree to comply with all applicable local and international laws, including export control regulations and data protection laws. You may not use the Service in any country subject to EU or US sanctions, or if you are listed on a restricted parties list.

18Modifications to Terms

We may update these Terms at any time. When we do, we will notify you by email or via the dashboard. Continued use of the Service after updates means you accept the revised Terms.

19Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium. Disputes shall be submitted to the competent courts of West Flanders.
